Cette fois-ci, ce sont avec les deux grands principes juridiques et moraux qui gouvernent notre rapport aux repr\u00e9sentations (\u00e9crits, images) \u00ab\u2009pornographiques\u2009\u00bb qu\u2019il exprime son d\u00e9saccord philosophique. Pourquoi en effet distinguer les repr\u00e9sentations sexuelles explicites ayant des qualit\u00e9s litt\u00e9raires et artistiques \u00e9videntes, celles-ci n\u2019\u00e9tant pas censur\u00e9es, de celles qui sont \u00ab\u2009m\u00e9diocres\u2009\u00bb ou vulgaires, celles-l\u00e0 devant l\u2019\u00eatre\u2009? Et qui d\u00e9cide de ce qui est m\u00e9diocre ou pas\u2009? <em>Idem<\/em> pour la distinction entre les \u0153uvres suscitant un <em>\u00ab\u2009sentiment esth\u00e9tique\u2009\u00bb<\/em> et celles visant exclusivement \u00e0 <em>\u00ab\u2009provoquer l\u2019excitation du public\u2009\u00bb<\/em>, qui permet de r\u00e9server la censure \u00e0 ces derni\u00e8res. Pour r\u00e9soudre ces difficiles questions, R. Ogien propose de distinguer entre offenses (blasph\u00e9mer, porter atteinte \u00e0 des choses abstraites, provoquer le d\u00e9go\u00fbt ou la g\u00eane) et pr\u00e9judice (imposition d\u2019une contrainte \u00e0 autrui, atteinte \u00e0 son int\u00e9grit\u00e9 physique, \u00e0 ses biens mat\u00e9riels). S\u2019appuyant sur des pol\u00e9miques et d\u00e9bats r\u00e9cents, il entend d\u00e9montrer que les offenses sont des <em>\u00ab\u2009crimes sans victimes\u2009\u00bb<\/em>.
